Terms of Service
Terms and conditions for using the MD Home Care platform to connect with disability and aged care providers.

1. Introduction
Welcome to MD Home Care. These Terms of Service ("Terms") govern your use of the MD Home Care platform, website, and related services. By accessing or using MD Home Care, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use this platform.
MD Home Care is a connection platform that helps NDIS participants, aged care recipients, and their families find and connect with vetted disability support and home care providers across Sydney and Melbourne. MD Home Care does not directly provide care services.
2. Service Agreements with Providers
When you connect with a provider through MD Home Care, you will enter into a separate Service Agreement directly with that provider. This agreement will outline:
- The specific services to be provided
- Service schedules and duration
- Applicable fees and funding arrangements
- Rights and responsibilities of both parties
- Cancellation and termination policies
MD Home Care is not a party to these agreements and is not responsible for the delivery of services by providers in the network. Any disputes regarding service delivery should be addressed directly with the provider.
3. Provider Network
Through MD Home Care, you can find providers offering a range of disability support and home care services, including but not limited to:
- Personal care assistance
- Domestic assistance
- Community access support
- Respite care
- Clinical care
- Therapy services
- Supported Independent Living (SIL)
The availability and scope of services may vary depending on location, provider availability, funding arrangements, and individual needs assessment. MD Home Care makes no guarantee that specific services or providers will be available at any given time.
4. Your Responsibilities
When using the MD Home Care platform, you agree to:
- Provide accurate and complete information about your needs, medical history, and support requirements
- Treat providers and MD Home Care staff with respect and dignity
- Maintain a safe environment for service delivery (when engaging providers)
- Comply with the terms of any Service Agreements entered into with providers
- Comply with NDIS rules and regulations (for NDIS participants)
- Inform MD Home Care and providers of any changes to your circumstances that may affect service delivery
5. Fees and Payment
Fees for services are outlined in Service Agreements between you and individual providers, and may be:
- Funded through the NDIS for eligible participants
- Covered by Home Care Packages or other government programs
- Paid privately
MD Home Care does not charge participants for connecting with providers through the platform. Payment for services is made directly to the provider delivering the care, in accordance with your Service Agreement with them.
Providers may charge cancellation fees or other charges in accordance with their Service Agreements and applicable regulations.
6. Cancellation and Service Changes
Cancellation policies are determined by individual providers and detailed in your Service Agreement with them. Generally:
- Cancellations with adequate notice (as specified in Service Agreements) will not incur charges
- Late cancellations may result in full or partial service charges
- Repeated cancellations may affect service scheduling and availability
For NDIS-funded services, cancellation policies must align with the NDIS Price Guide.
7. Privacy and Confidentiality
MD Home Care is committed to protecting your privacy and maintaining the confidentiality of your personal and health information. Our collection, use, and disclosure of your information is governed by our Privacy Policy and applicable privacy laws.
By using the MD Home Care platform, you consent to our collection, use, and disclosure of your information as outlined in our Privacy Policy. Individual providers may have their own privacy policies governing information collected during service delivery.
8. Feedback and Complaints
MD Home Care values your feedback and is committed to continuous improvement. If you have concerns or complaints about:
- The MD Home Care platform: Please contact us directly to discuss the matter
- A provider's service delivery: Contact the provider directly in the first instance, or contact MD Home Care for assistance in resolving the issue
If your complaint cannot be resolved directly, you may also contact the NDIS Quality and Safeguards Commission or other relevant authorities.
9. Limitation of Liability
To the extent permitted by law:
- MD Home Care is a connection platform and is not responsible for the quality, safety, or delivery of services provided by providers in the network
- MD Home Care is not liable for any loss or damage arising from your use of the platform or services provided by third-party providers
- MD Home Care is not liable for any indirect, special, or consequential loss or damage, loss of profit, or loss of opportunity
While MD Home Care takes reasonable steps to vet providers in the network, you are responsible for assessing whether a provider is suitable for your needs.
Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition, implied or imposed by any legislation that cannot lawfully be excluded or limited.
10. Termination of Platform Access
MD Home Care reserves the right to suspend or terminate your access to the platform if:
- You breach these Terms
- You engage in conduct that harms providers, other participants, or MD Home Care staff
- You provide false or misleading information
- Your use of the platform poses a risk to others
Termination of platform access does not automatically terminate Service Agreements with providers, which are separate contractual arrangements.
11. Changes to Terms
MD Home Care may update these Terms from time to time to reflect changes in platform functionality, legal requirements, or business practices. The updated Terms will be posted on this website, and the revised version will be effective from the date of posting.
Continued use of the MD Home Care platform after any changes to these Terms constitutes your acceptance of the revised Terms.
12. Governing Law
These Terms are governed by the laws of New South Wales, Australia. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts of New South Wales.
